UCP 600

UCP 600 is the Uniform Customs and Practice for Documentary Credits, 2007 Revision, ICC Publication No. 600. It is the International Chamber of Commerce rule set that governs letter of credit transactions worldwide when the credit expressly indicates that it is subject to those rules. UCP 600 came into effect on 1 July 2007 and reduced the rule text from 49 articles under UCP 500 to 39 articles.

UCP 600 use on bank export finance desks

On EF and trade desks, UCP 600 is the default private rulebook for commercial documentary credits that finance shipment of goods against presentation of complying documents. Issuing, advising, confirming and nominated banks examine presentations against the credit, the UCP and international standard banking practice. A confirmed letter of credit adds the confirming bank's independent undertaking under the same framework. Standby letters of credit may be made subject to UCP 600 to the extent the rules apply, though many standbys instead incorporate ISP98.

Article 1 states that the rules bind all parties to the credit unless expressly modified or excluded. Credits are independent of the underlying sale or other contract. Banks deal with documents, not with goods, services or performance. Honour means sight payment, deferred payment at maturity, or acceptance and payment of a draft, according to how the credit is made available. Negotiation means purchase of drafts and/or documents under a complying presentation by advancing or agreeing to advance funds.

Examination mechanics and electronic presentation

UCP 600 introduced dedicated Definitions and Interpretations articles. ICC Switzerland materials highlight the replacement of "reasonable time" for acceptance or refusal of documents with a firm period of five banking days, clearer negotiation-as-purchase wording, and provisions that allow discounting of deferred payment credits. Article structure covers availability and expiry, issuing and confirming bank undertakings, amendments, nomination, reimbursement, the standard for examination of documents, discrepant documents and notice, originals, invoices, transport and insurance documents, force majeure, transferable credits and assignment of proceeds.

The publication includes the eUCP supplement for presentation of documents in electronic or partly electronic form. Current ICC Knowledge 2 Go editions of UCP 600 include eUCP Version 2.1. Where parties need demand-guarantee rules rather than documentary credit rules, they look to URDG 758. Where the instrument is a collection rather than a credit, documentary collection practice applies under separate ICC collection rules.

Boundaries and incorporation discipline

UCP 600 is not a statute. It applies by contractual incorporation in the credit text. National law still governs capacity, sanctions, insolvency and fraud exceptions. Soft clauses, non-documentary conditions and poorly drafted transport requirements remain credit-risk and operational issues even when UCP 600 is stated. Desks therefore read the credit's availability, expiry, presentation place and confirmation instructions together with the UCP articles, rather than treating the publication number as a complete operating manual.
