Atradius Dutch State Business explained

Atradius Dutch State Business is the official Dutch export credit agency: it issues export credit insurance and guarantees on behalf of and for the account of the State of the Netherlands when private market cover is not available for the risk, tenor or size of the transaction.

Public executor within the Atradius Group

Atradius Dutch State Business is part of the Atradius Group and is operationally separate from Atradius private credit insurance written on the group's own balance sheet. The Ministries of Finance and Foreign Affairs have policy responsibility for the export credit insurance instruments. All premiums, claims payments and collection proceeds are for the account and risk of the Dutch State. For its work as executor, Atradius Dutch State Business receives a fixed annual fee from the state.

The legal predecessor Nederlandsche Credietverzekeringsmaatschappij (NCM) began insuring credit in 1925. In 1932 NCM signed a cooperation agreement with the Ministry of Finance to reinsure export credits. Since 1932 the Dutch official export credit insurer role has continued through that lineage into Atradius Dutch State Business. From 2010 the Dutch state became the direct insurer and Atradius Dutch State Business worked as executor for the state.

Atradius Dutch State Business is listed as a Berne Union member. Its annual review describes it as the official export credit insurer or ECA on behalf of the government, managing and advising on an insurance portfolio of approximately €16 billion for the Dutch state with a specialist team.

Products and complementarity

Atradius Dutch State Business offers insurance and guarantees for exporters of capital goods, international contractors, banks and investors. Published product families include an exporter's policy for capital goods and services against political and commercial non-payment, contractor insurance for international projects, buyer credit insurance for banks and financiers, investment insurance, foreign exchange risk insurance, and specialised covers such as financial lease insurance.

The Dutch Good Growth Fund and Dutch Trade and Investment Fund provide export credit insurance and financing routes for defined developing and other markets. Direct guarantee and financing products support bank and lessor structures. An export credit guarantee or insurance policy under this mandate can support buyer credit lending to foreign buyers of Dutch exports or supplier credit style receivables risk where the exporter extends payment terms.

The basic principle is that the export credit insurance facility should not distort the market. For risks that a commercial insurer can cover, public export credit insurance is in principle not available. Periodically the state determines which risks by country, duration and transaction size are not commercially insurable and may qualify for public cover. That complementarity distinguishes Atradius Dutch State Business from private Atradius policies.

OECD Arrangement and EU rules

The Netherlands participates in the OECD Arrangement on Officially Supported Export Credits. The European Commission participates in the Arrangement on behalf of EU member states. Atradius Dutch State Business advises and forms part of the Dutch representation. Arrangement rules for EU member states are legally reflected in EU regulations, and EU state aid rules are also relevant for many products.

Officially supported export credits with repayment terms of two years or more fall under Arrangement disciplines on repayment terms, minimum premium benchmarks and related transparency. Short-term marketable risks remain bounded by EU short-term export credit insurance communications that reserve public cover for non-marketable risks.

Since 2021, Invest International offers export financing on behalf of the Dutch government, often with cover from Atradius Dutch State Business to mitigate risks. Commercial banks remain primary arrangers and lenders on many transactions; state-account insurance reduces capital and credit risk for those banks under the policy terms.

Atradius Dutch State Business in documentation

Atradius Dutch State Business participation appears as a policy or guarantee issued in the name of and at the risk of the Dutch State. The bank or exporter is the insured. Documentation sets insured percentage, covered political and commercial risks, exclusions, waiting periods, premium and claims cooperation. Security such as mortgages on delivered assets may be required to support recoveries after claim payment.

Promises of cover and advice of cover are intermediate contractual steps used before a final policy is issued when the underlying transaction is committed. After indemnification, recoveries and Paris Club treatments of sovereign claims follow state-creditor practice because the Dutch State is on risk. Claims on corporate buyers remain commercial recoveries under the policy and any security package.

Portfolio statistics in the 2024 annual review show Export Credit Insurance premiums, claims, recoveries, promises of cover and policy volumes by year, alongside Dutch Good Growth Fund and Dutch Trade and Investment Fund activity. Total portfolio figures in the same review are expressed in billions of euro of commitments. Those figures describe institutional flow and stock. They are not eligibility thresholds for individual applications and do not replace country policy, ceilings or underwriting criteria published for each destination.

Sectors that commonly use Dutch ECA instruments include maritime, technology, medical, mechanical engineering, hydraulic engineering and agri-food, as stated on the organisation pages. Green cover and SME-oriented distribution are policy priorities described in recent annual reporting, without changing the legal character of state-account insurance.

Credit review of a Dutch officially supported export identifies whether private cover is unavailable, which Atradius Dutch State Business product applies, whether OECD Arrangement terms govern the tenor, the Dutch interest or content requirements applicable to the facility, and how insurance proceeds connect to the loan or receivable. Peers such as UKEF, Hermes cover and US EXIM likewise provide official national cover under different institutional designs. Atradius Dutch State Business is therefore the Netherlands' state-account ECA executor within the Atradius Group, complementary to private credit insurance and aligned with OECD Arrangement and EU export credit rules.
